Privacy Policy

This Privacy Policy was last modified and is effective as of April 2023

This policy was compiled to better serve those who are concerned with how their “Personally Identifiable Information” (PII) is being used.  PII is described as information that could be used on its own or with other information to identify, contact, or locate a single person.  Above and Beyond – Business Tools and Services for Entrepreneurs, Inc. and its affiliates and subsidiaries (collectively “Get Beyond” “we”, “us”, “our”) is committed to protecting the privacy of its users.  The following Privacy Policy (1) applies to you when you visit and use our Services, and (2) discloses how we collect, use, protect, or otherwise handle information and data we gather about you; and (3) sets out your options with respect to Get Beyond’s access to your information.   

The Privacy Policy also applies to the following: (i) the getbeyond.com website (the “Site”) or other Get Beyond websites, including any online accounts thereunder, (ii) Get Beyond products or services, including, without limitation, software, mobile applications, online services, network services, hardware or devices, or (iii) other products and services that specifically reference or link to this Privacy Policy (collectively, the “Services”), regardless of the means by which you access the Services, such as by your use of a computer, mobile device or other device(s).  The Services do not include websites, mobile applications, devices, hardware, software, other products, or other services that reference, operate under, or link to another privacy policy. 

What Information do we collect?

Information collected directly by Get Beyond

When you use our Services, communicate with us, or register for an account with Get Beyond, we may request and collect certain information, including, but not limited to, (i) contact information, such as your first and last name, phone number, email address, physical address, city and state, postal code; (ii) demographic information, such as your age, gender, interests, education, profession, occupation, income level, marital status; (iii) transaction information, such as your credit/debit card number and security code; and (iv) other information, such as applicable business information. We may also ask you for information about your system or how you use Get Beyond products and services, and we will collect information through your use of the Services, including your actions taken on the Service and your communications with others through the Services.

Get Beyond gathers information about all users collectively, such as what areas users visit most frequently and what services users access most often. Get Beyond automatically logs IP addresses, session sources, and other data which tracks users’ access to the Services. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

When you access our Services by or through a device, including, without limitation, a mobile device, we may receive or collect and store information, including, without limitation, IP address, referring URLs, access times, browser type, device settings, unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers (“IDFA”), Google Ad ID, or Windows Advertising ID), mobile carrier, device type and identifiers, model and manufacturer, device operating system brand and model, phone number, and, depending on your device settings, your geographical location data, including GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your device.

Information collected from third parties

In the course of providing our Services to you, we may collect information about you or your business from third parties. For instance, information about you may be collected from interactions you have with our merchant customers or other entities that utilize our Services.  It is also contemplated that for some Services we are providing to you, we may also collect information pertaining to those Services from third parties, such as credit reporting agencies or financial institutions, or other entities. Prior to the collection of information from a credit reporting agency, where the Services we are providing you can result in such collection, a separate authorization shall be obtained from you.

Cookies, Web Beacons, and Information Saved by Other Technologies

  • Cookies.   Cookies are small (text) files that a site or its service provider transfers to your device, such as a computer’s hard drive through your web browser (if you allow) or that can be stored on a mobile device, that enables the site’s or service provider’s systems to recognize your browser or device and capture and remember certain information.  Cookies are useful because they allow a website to recognize a user’s device. If you have registered for a user account on the Site, these cookies may let us know who you are, may be necessary to access your account information, and may provide us and our service providers with information that we will use to personalize the Services in accordance with your preferences.  These cookies may also allow us to remember and process the items in your shopping cart, understand and save user’s preferences for future visits, compile aggregate data about Site traffic and Site interactions in order to offer better site experiences and tools in the future.  We may also use trusted third-party services that track this information on our behalf.
  • Web Beacons.  A web beacon, also commonly referred to as a web bug, internet tag, pixel tag, or clear GIF, is a very small HTML-formatted graphic image or other object that is placed on a web page or in an email, that can be used to track the online actions and activity of users by transmitting information back to a web server.  This technology may allow us to understand which pages you visit on the Services and is used to help us optimize and tailor the Services for you and other future visitors to the website. It may also allow third parties to obtain information, such as the IP address of the computer that downloaded the page on which the web beacon appears, the URL of the page on which the web beacon appears, the time the page containing the web beacon was viewed, the type of browser used to view the page, and the information in cookies sent by the third party.
  • Other Technologies.  Local shared objects (LSOs), such as local storage or HTML5 Local Storage.  Local storage is similar to browser cookies but can store data more complex than simple text. By itself, local storage cannot do anything to or with the data stored on your device. Like cookies, local storage can only access personal data that you have provided on the Services.  Third parties with whom we partner to provide certain features on the Services or to display advertising based upon your web browsing activity may also use Flash cookies or HTML5 to collect and store information. Various browsers may offer their own management tools for removing HTML5.

HubSpot and Salesforce

We currently use HubSpot for all web forms.  HubSpot communicates with Salesforce to collect information about visitors to our website.  We use this information to generate leads and analyze who is visiting our website.

How does Get Beyond use your information?

In addition to the uses made of the information stated above, we may use the information we collect from you in the following ways:

  • To facilitate your access to and use of the Services. 
  • To provide, manage, and administer the Services.
  • To improve our Site and Services in order to better serve you.
  • To follow up with you after correspondence (live chat, email, or phone inquiries).
  • To maintain internal recordkeeping and reporting.
  • To analyze sales and marketing data and to analyze customers trends.
  • To detect and prevent unauthorized use of the Site or Services.
  • To monitor compliance with the law and our Terms of Use.
  • To enforce our legal rights and satisfy our legal obligations, including without limitation any reporting or disclosure obligations under applicable law or regulations or subpoena, court order or other judicial or administrative process, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property, or the rights, property or safety of others.
  • To transfer information and/or assets in the event of a merger, acquisition, sale, or other corporate restructuring.
  • For any other purpose permitted under applicable law and regulation or agreed to in this Privacy Policy or disclosed at the time the information is collected.

How does Get Beyond Protect your information?

Get Beyond implements and maintains reasonable physical, technical, electronic, administrative and managerial procedures (security measures) to protect information transmitted to us online and collected and stored in our servers.  Security safeguards may include but are not limited to secured networks, data encryption, firewalls, data use and access limitations/restrictions, confidentiality requirements, and physical access controls to our servers.    

The Services are hosted on servers inside the United States and we may store and process (i.e., use and disclose) information throughout the United States.  Information collected by Get Beyond about you, including personal information, may be transferred across borders and from your country or jurisdiction to other countries or jurisdictions around the world. By using our Services and providing information to use, you are advised and hereby consent to the transfer and processing of information, as described in this Privacy Policy, in facilities that may be located in the United States.  You acknowledge this consent applies to you if you are located in the European Union or elsewhere outside the United States with laws governing data collection and use that may differ from U.S. law.

Of course, we cannot guarantee that your communications with the Site or Services will never be unlawfully intercepted or that your personal data will never be unlawfully accessed by third parties. Any transmission of information is at your own risk.  Therefore, we urge you to always use caution when transmitting information over the Internet and remind you that you are responsible for ensuring the security of your information, password(s) and account registration information.  If you have lost your password or believe it is compromised, we recommend that you immediately change your password.  Get Beyond is not liable for any harm resulting from the loss of passwords due to user negligence.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information, without your consent, except to the extent described in this Privacy Policy.  When your information is collected on the Services, it may be shared with selected third parties who assist us with our business operations, with the provision of the Services, with our marketing or advertising campaigns, or in delivering you the features and functionality that you have requested (collectively referred to herein as “Third-Party Processors”). These Third-Party Processors include companies, as identified previously, that help us understand usage preferences and other analytics regarding the Services, process transactions (i.e., credit card, debit card, gift card, or other payment information); handle advertising, marketing, promotions, gift cards and/or shipping for us; provide fraud prevention and collections; and deliver information and materials to you via e-mail or postal service, for example.  Third-Party Processors are authorized to use the personal data that we provide to them only to carry out the service they are providing for us.

Business Transactions

We continually look for ways to improve our business, including purchasing a business or selling all or part of our business. We reserve the right to transfer any information we collect in the event we buy, merge, reorganize or sell any business and/or assets (including any shares in the company) or any portion or combination of our products, services, businesses and/or assets.  The occurrence of a divestiture, merger, acquisition, bankruptcy, dissolution, reorganization, liquidation, or similar transaction or proceeding, you are hereby informed that personal data and non-personal information will likely be disclosed or transferred as part of the transaction. We will use reasonable efforts to ensure that any personal information transferred shall be handled in a manner consistent with the Privacy Policy.

Other Websites, Other Services, Plugins, and Links

We may offer third-party products or services on our Site. The Services may provide links to (or links from) webpages located on websites or services maintained by various other entities. In that case, the URL will identify the site you are visiting. These other sites and services are not bound by our Privacy Policy, and we are not responsible for their information collection and use practices. We strongly encourage you to review the privacy policy of any site or service before providing any personal information.

Other Companies Offering Promotions

We may share demographic information, location data, advertising identifiers, IP address, and aggregate (not individual) usage statistics for the Services with advertisers and other third parties.  At times, we will provide you with the opportunity to opt-in to receive promotions from third-party sponsors. You should review the privacy policies of these third parties before supplying personal data to them.

What are your options?

Opting Out

Users can opt out of being tracked by Google Analytics Demographics and Interest Reporting cookies through Google Ads Settings here (https://www.google.com/settings/u/0/ads), by installing a Google Analytics Opt-Out Browser Add-on here: (https://tools.google.com/dlpage/gaoptout/); or by visiting the Google Analytics opt-out page here (https://tools.google.com/dlpage/gaoptout/).  You may also opt-out of additional third-party advertising networks by going to the Network Advertising Initiative’s website at www.networkadvertising.org and following the directions.  You can also opt-out of future information collection from the Services by ceasing use of the Services or uninstalling the relevant mobile application(s).

The opt-outs described above may be device- or browser-specific and may not work on all devices. If you choose to opt-out through any of our Ad Partners’ sites, you still may see advertisements, but the advertisements will not be based on your interests.

Access to and Modification of your Information

If you have a registered user (online) account with us, Get Beyond offers users the ability to modify certain information collected in your account (e.g., reset your password, update your contact information, delete your account, or opt-out of certain Services). Users may change this information at any time and as often as necessary by choosing the designated functionality that is offered in the Services. To access or modify your information, log in to your account through the Services. Cookie and Location Controls

Your browser, such as Internet Explorer, Chrome, Firefox and Safari, may allow you to manage or modify your cookies and local storage.  Because each browser is a little different, we encourage you to check your browsers’ “Help” feature to learn how to block cookies or other tracking/recording tools, how to receive notification of new cookies (warning you each time a cookie is being sent), and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all the Services and some parts of the Services may not function properly. Do Not Track signals

Some browsers incorporate a Do Not Track feature that signals to websites you visit that you do not want to have your online activity tracked.  We are not able to honor Do Not Track (DNT) signals from your browser at this time because the Site or Services are not set up to support, interpret or respond to DNT signals.  As such, we do not knowingly track your online activity over time across third-party websites when you use our Site or Services. Tracking is not the same as using or collecting information in connection with a single website. For these purposes, tracking refers to collecting personally identifiable information from consumers who use or visit a website or online service as they move across different websites over time.

Third Party Behavioral Tracking

We do not support third-party behavioral tracking, except to the extent described in this Privacy Policy.

California's "Shine The Light" Law

If you are a California resident, California’s “Shine The Light” law permits you to annually request and obtain information regarding disclosure made by Get Beyond of your personal information in the preceding calendar year.  To make such a request, please send an email to admin@getbeyond.com.

Privacy Rights for California Minors in the Digital World

If you are a California resident under age 18 and are a registered user of the Site or any of the Services, then you may request that we remove any Submissions that you publicly posted on or in the Site or Services.  To request removal of a Submission, please send a detailed description of the specific Submission to admin@getbeyond.com. We reserve the right to request that you provide information that will enable us to confirm that the Submission that you want removed was created and posted by you.  We will make a good faith effort to delete or remove your Submission, but your Submission may remain on backup media, cached or otherwise retained by us for administrative or legal purposes or your Submission may remain publicly available if you or someone else has forwarded or reposted your Submission on another website or service prior to its deletion. We may be required by law to not remove or allow removal of your Submission.

COPPA (Children Online Privacy Protection Act).

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control.  We do not knowingly collect information from, allow registration by, send unsolicited promotions to, or specifically market to children under the age of 13 years old. The subject matter of the Site and Services is not directed to child-oriented activities and does not employ content that may be reasonably considered as appealing to children.  If you become aware that we have collected personal data from a child without parental consent, please notify us promptly at admin@getbeyond.com.  If we become aware that a child under age 13 has provided us with personal data without parental consent, we will take steps to remove such personal data.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to (a) Send information, respond to inquiries, and/or other requests or questions; and (b) Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

We agree to the following: (a) Not to use deceptive, false or misleading header information, subject lines, or email addresses; (b) Identify the message as an advertisement in some reasonable way; (c) Include the physical address of our business or Site headquarters; (d) Monitor third-party email marketing services for compliance, if one is used; (e) Honor opt-out/unsubscribe requests in a commercially reasonable timeframe; and  (f) Allow users to unsubscribe by following directions or using the link provided at the bottom of each email.

Changes to Privacy Policy

Get Beyond reserves the right to change our Privacy Policy at our sole discretion and encourages you to check this page periodically.  If we decide to change our Privacy Policy, we will post those changes here whereupon they shall take immediate effect. 

The latest version and effective date are published on the top of this page.  Your continued use of the Site or Services after changes have been posted will constitute your acceptance of this Privacy Policy and any changes made to it.
